Terms of Use

Any connection to the site is subject to compliance with these terms. For the user, merely accessing the following URL https://mcalts.fr implies acceptance of all the conditions described below.

The French version of this document is the governing one. Other languages are provided for information only.

1. DEFINITIONS

Personal Data : means the personal information that the User recorded when registering for the Specific Service offered by MCALTS (namely access to .pdf documents) and/or provided in the course of using the Services.

Intellectual Property Rights : means trademarks, domain names, authors' rights, copyrights, designs and models, patents, rights over Databases or any other intellectual property rights exploited by MCALTS and necessary to its activities as a Service provider.

Form : means the registration or information request form that the User may complete in order to benefit from certain MCALTS services after having read these Terms of Use.

Hypertext Link : means the referencing system embodied by a word, an icon or a logo which allows, with a click of the mouse, moving from one document to another on the same website, or from a page of one website to the page of another website.

Services : means all the services, including the Specific Services, offered by MCALTS to Users through its website mcalts.fr.

Website : means the Internet site made available to the public through the Internet at the URL https://mcalts.fr

User : means the natural person, of legal age and legal capacity, using the Services offered by MCALTS.

2. PURPOSE

The purpose of these Terms of Use is to define the terms and conditions under which MCALTS provides the Services to Users. Any use of one of the Services offered by MCALTS shall comply with these Terms of Use.

3. ACCEPTANCE OF THESE TERMS OF USE

The User declares that they have read and expressly and unconditionally accepted these Terms of Use in force on the day of accessing the website and subscribing to the Services offered by MCALTS.

MCALTS reserves the right to modify all or part of these Terms of Use at any time. It is therefore up to the User to refer regularly to the latest version of the Terms of Use, permanently available on the MCALTS Site. Any use of the Services after modification of the Terms of Use constitutes the User's plain and simple acceptance of the new Terms of Use.

4. INTELLECTUAL PROPERTY RIGHTS

The User acknowledges that MCALTS is the sole owner of the Intellectual Property Rights relating to the MCALTS Site and to the Editorial Content.

No provision of these Terms of Use may be interpreted as granting the User a licence over the Intellectual Property Rights which MCALTS may own or have the exclusive right to exploit.

MCALTS grants only an authorisation to view its Editorial Content on a personal and private basis, to the exclusion of any public viewing or distribution.

Consequently, any representation, reproduction or extraction of the Editorial Content or of its website, as well as of any other Intellectual Property Right, not authorised by MCALTS is strictly prohibited under penalty of legal proceedings. The offender is liable to civil and criminal penalties, in particular those provided for in articles L. 335.2 and L. 343.1 of the French Intellectual Property Code.

5. LIABILITY

The User expressly acknowledges that they must exercise judgement in using the Editorial Content and bear all the risks relating thereto, in particular when relying on the appropriateness, usefulness or completeness of this Editorial Content, and must carry out any verification under their own responsibility.

The MCALTS team takes all the care it deems necessary in compiling the Editorial Content. However, MCALTS gives no guarantee as to the reliability of the information in the Editorial Content. Accordingly, MCALTS may not be held liable for damage resulting from the User's use, for any purpose whatsoever, of the information making up the Editorial Content.

The MCALTS Site contains Hypertext Links to websites managed by third parties. MCALTS cannot exercise any control over these sites nor assume any responsibility for their content. The inclusion of these links does not mean that MCALTS approves the material contained on these sites. MCALTS cannot be held liable for the content of these sites, and the fact that these sites are referenced on the MCALTS Site in no way engages the liability of MCALTS. MCALTS therefore gives no guarantee concerning:

In addition, the User indemnifies MCALTS against any claim or action that may be brought against it on any basis and for any reason whatsoever, and more generally in connection with the entry of data or information, by any person who considers themselves harmed by the publication of such data or information on the website, and undertakes to hold it harmless against all judicial and extrajudicial costs that may result therefrom.

6. ACCEPTANCE OF THE RISKS OF THE INTERNET

The User declares that they are well acquainted with the Internet, its characteristics and its limits, and in particular acknowledges:

MCALTS cannot guarantee that the information exchanged will not be intercepted by third parties, nor that the confidentiality of exchanges will be guaranteed.

MCALTS informs the User of the existence of rules and practices in force on the Internet known as Netiquette, as well as of various codes of conduct and in particular the Internet Charter, accessible on the Internet.

7. ACCESSIBILITY OF THE SERVICES

MCALTS endeavours as far as possible to keep its website accessible 7 days a week and 24 hours a day, but may interrupt access, in particular for maintenance and upgrade reasons or for any other reason, in particular technical. MCALTS is in no way responsible for these interruptions and the consequences that may result for the User.

MCALTS reserves the right to refuse any User access to all or part of the MCALTS Site unilaterally and without prior notice, in particular in the event of a manifest breach of these Terms of Use.

The User acknowledges that MCALTS may not be held liable for any direct or indirect damage arising from the removal of the User's access to the MCALTS Site.

8. CONDITIONS OF ACCESS TO THE SERVICES

8.1 CONDITIONS OF ACCESS TO THE FREE SERVICES

Access to the Editorial Content of the MCALTS Site is entirely free and unrestricted.

8.2 CONDITIONS OF ACCESS TO THE FREE SPECIFIC SERVICES

Use of the Specific Services requires the User to comply with a registration procedure through which they must provide their contact details. The User undertakes that the information provided, in particular personal information, is accurate, complete and up to date, and to make the modifications necessary for that purpose.

In return for the free provision of Specific Services, you agree, as a User, to receive at most once a week a commercial offer by email sent by mcalts.fr or its partners.

At any time, you may object to receiving this type of offer. Every advertising message contains a link allowing the mailings to be stopped and your unsubscription.

As part of this procedure, the User declares that they have read and expressly accepted these Terms of Use in force on the day of subscribing to the Specific Services, by clicking on the icon entitled "I accept the Terms of Use: send the data". Any acceptance expressed by the User by a click has the same value as their handwritten signature. By making this click, the User is deemed to have given their consent irrevocably.

9. PERSONAL DATA - CONFIDENTIALITY OF THE DATA COLLECTED

MCALTS collects information provided by Users:

Aware that the collection and processing of Personal Data on the Internet must respect the fundamental rights of individuals, MCALTS undertakes that any processing of personal data on the MCALTS Site complies with French Law no. 78-17 of 6 January 1978 on information technology, data files and civil liberties.

The User has a right of access (articles 34 to 38 of the 1978 Law) and a right of rectification (article 36 of the 1978 Law) to the Personal Data concerning them.

The User may exercise this right at any time by sending an email to the contact section of our website, namely to rectify, complete, clarify, update or erase information concerning them that is inaccurate, incomplete or out of date. A maximum period of 15 days is requested before the User's request is taken into account.

MCALTS undertakes to use its best efforts to protect Personal Data, in order to prevent it from being distorted, damaged or communicated to unauthorised third parties, in accordance with article 29 of the Law of 6 January 1978.
